Re: Limited Common Elements


An issue discussed at the annual meeting concerned Limited Common Elements, specifically the stairwells for second floor units.  Maintenance/cleaning for Limited Common Elements (2014 Restatement of Declarations, Section 4, para A.) is an owner responsibility, shared by both owners.  That responsibility/cost should be coordinated by/with the two owners, it does not involve/include mediation by the manager.  In fact, the manager has no role in the maintenance except to ensure the liability of the Association is protected, and that all the maintenance is performed in accordance with the Association’s standards.  The Association/manager may also maintain contacts for resources for owners to contract for maintenance.


Additionally, the manager shall alert the Board of any Limited Common Elements which may be in disrepair, so that the Association may return the Limited Common Element to compliance with standards, and assess the owner(s) as appropriate.
